GENERAL TERMS AND CONDITIONS

1. CANCELLATION OF INDIVIDUAL CONSULTATION BY PARTICIPANT

Cancellation of individual consultation (appointment) must be communicated at least 48 hours before the appointment, so we can reorganize and operate in an atmosphere of good mutual cooperation. In case of cancellation less than 48 hours before the appointment, we charge the full service fee. You are exempt from payment in case of cancellation due to urgent reasons such as illness (medical certificate), accident, etc., which you must notify us about as soon as possible.

 

2. CANCELLATION OF SEMINAR/EVENT PARTICIPATION BY PARTICIPANT

A person/company that has registered for a workshop/seminar/training can cancel their registration no later than 15 (fifteen) days before the scheduled start date of the workshop/seminar, by notifying us via email at: info@nejazupan.com. In such case, 80% of the paid fee will be refunded to the person/company within 15 days of receiving the cancellation. In case of cancellation less than 15 (fifteen) days before the start of the event (workshop/seminar), we charge the full service fee, unless the person/company demonstrates with evidence upon cancellation that they could not cancel the registration earlier due to urgent reasons beyond their control (e.g., serious illness (medical certificate), accidents, etc.). In the latter case, the fee refund is reduced by administrative costs amounting to 20% of the regular fee.

If a person/company registers for a workshop less than 15 working days before the scheduled workshop date, cancellation is not possible.

In case of cancellation after the start of the workshop/seminar, fee refund is not possible.

 

3. CANCELLATION BY ORGANIZER

The organizer reserves the right to cancel individual training, workshops, events, seminars, or change schedules. The organizer commits to notifying registered participants at least 7 (seven) days before the scheduled start of training. In case of individual consultation, at least 1 (one) day before the consultation appointment. Later cancellation than stated is only possible due to urgent reasons beyond the organizer’s control (e.g., accidents, sudden illness, etc.). In case of training cancellation by the organizer, the organizer will refund any already paid fee without interest within 15 (fifteen) days of the cancellation notice, or allow the client to use the fee for other products or services.

 

4. PURCHASE AND PAYMENT OF PROGRAMS ON THE ORGANIZER’S WEBSITE

An order for an individual product or registration for training is considered placed from the moment the customer enters their data and submits the order. The customer places an order on individual pages by clicking clearly marked buttons. After clicking the order button, the customer is redirected to the online store where they can review orders, select quantities, and enter discount codes. By clicking the continue order button, the customer is redirected to a page where they enter their data required for the order (name, surname, address, email address, phone number, company name, comments). On the same page, the customer chooses from offered payment methods and reviews the order summary. Before executing payment, the customer must agree to the Payment Terms.

The order is completed by clicking the button at the bottom of the page. By ordering a product, the customer commits to settle the amount for the product purchase according to the terms found on the website.

After submitting the order, the customer is redirected to a final page with an order summary, and simultaneously receives a message to their email address that the order is being processed (for bank transfer payment) or that the order is confirmed (for direct payment).

For payment to the organizer’s bank account, the organizer sends the customer an email message about the completed order after receiving payment.

ONE-TIME PAYMENT

One-time payment can be made by the customer through payment to the organizer’s bank account, or by payment with debit or credit cards (Activa, MasterCard, BA Maestro, Visa, Visa Electron, American Express). In case of one-time payment to the bank account, the customer commits to settling the full amount within 7 working days from the completed registration.

DISCLAIMER OF LIABILITY

Various forms of counseling and programs at Neja Zupan do not fall under officially recognized forms of therapeutic help or officially recognized programs. Counseling and training in no way replace traditional therapeutic approaches or treatment. We offer our knowledge and experience as persons who have been educated by various authors and in programs in Slovenia and abroad, and we wish to share our knowledge and experience exclusively for the purpose of improving individual quality of life through different understanding of life situations. Counseling and programs/seminars are intended for gaining another possible perspective on various life situations. We do not engage in healing and do not treat people. The word ‘treatment’ or ‘healing’ is mentioned solely in the direction of improving quality of life by gaining a different view of reality, and in no way in the direction of physical or psychological treatment. For attending counseling or training within our offer or performing procedures mentioned in Neja Zupan’s programs, the individual takes full responsibility. In case of doubt whether our training or counseling is suitable for you or someone who is in the process of treatment (psychological or physical), we advise consulting with your doctor or official therapist before visiting.

The client alone is completely responsible for their physical health and well-being.

Our natural healing specialists only advise and do not diagnose disease conditions, do not perform medical treatments, do not prescribe medications, or interfere in any way with official medical treatments – follow your doctor’s instructions regarding prescribed treatment and medications for physical, mental, or emotional health problems.

By attending counseling or training or performing programs from our website or purchasing programs, you agree to the above-mentioned terms and take full responsibility for your participation and program execution.

 

5. GOVERNING LAW AND JURISDICTION

These terms and conditions are governed by and construed in accordance with the laws of Slovenia. Any disputes arising from or relating to these terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of Slovenia.

 

6. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These terms, together with our Privacy Policy, constitute the entire agreement between you and Neja Zupan regarding your use of our website and services.

 

7. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, pandemics, or technical failures of third-party systems.

10. COMMUNICATION

Neja Zupan will contact the user via remote communication means only if the user expressly consents to this. Advertising electronic and/or SMS messages will contain the following components:

– they will be clearly and unambiguously marked as advertising messages, – the sender will be clearly evident, – various actions, promotions, and other marketing techniques will be marked as such.

The conditions of participation in them will also be clearly defined: – the method of unsubscribing from receiving advertising messages will be clearly presented, – Neja Zupan will expressly respect the user’s wish not to receive advertising messages.

REVIEWS, OPINIONS, AND RECOMMENDATIONS

– Opinions, reviews, and recommendations written by customers are part of the functionality of the nejazupan.com website and are intended for the community of all users.

– nejazupan.com allows any website user to write an opinion, but Neja Zupan reviews them before final publication. Neja Zupan will not publish opinions or contributions that are in any way offensive, inappropriate, or that, in Neja Zupan’s assessment, do not provide benefit to other users and visitors.

– By submitting an opinion or comment, the user expressly agrees to the terms of use of their opinion or comment and allows Neja Zupan to publish part or all of the text in all electronic and other media. Neja Zupan has the right to use the content of the opinion or comment without time limit and for any purpose that is in Neja Zupan’s business interest, including publication in advertisements or other marketing communications. LIMITATION OF LIABILITY

Neja Zupan strives to the best of its ability to ensure the timeliness and accuracy of data published on its websites. However, prices and articles can change quickly, so Neja Zupan sometimes cannot update the data on websites. In such cases, Neja Zupan will notify the customer of changes and allow them to withdraw from the contract or replace the ordered article or service.

EXCLUSION OF LIABILITY

We reserve the right to disable the website or disable access to it due to technical or other difficulties and maintenance, which also means disabling or hindering the use of the website. In case of technical difficulties on the website, we reserve the right to cancel submitted orders that have been affected by technical errors. In case of order cancellation, we will notify you as soon as possible and inform you of further steps. You must ensure adequate equipment protection (antivirus, etc.) before accessing and using the website. The customer must ensure adequate security and confidentiality of data used for website login (email address, password).

COMPLAINTS AND DISPUTES

Neja Zupan respects applicable European consumer protection legislation. Neja Zupan strives to fulfill its obligation to establish an effective complaint handling system and designate a person with whom the customer can contact by phone or email in case of problems.

Complaints are submitted via email address info@nejazupan.si. The complaint handling procedure is confidential. Neja Zupan will confirm receipt of the complaint within five working days, inform the customer how long it will be processed, and keep them informed about the procedure progress.

Neja Zupan is aware that the essential characteristic of consumer disputes, at least regarding judicial resolution, is the disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle preventing consumers from initiating disputes in court. Therefore, Neja Zupan strives to the best of its ability to resolve potential disputes amicably.

In case of judicial dispute resolution, the competent court is according to the consumer’s permanent residence.

EXTRAJUDICIAL CONSUMER DISPUTE RESOLUTION

In accordance with legal regulations, we do not recognize any provider of extrajudicial consumer dispute resolution as competent for resolving consumer disputes that a consumer could initiate in accordance with the Law on Extrajudicial Consumer Dispute Resolution. Neja Zupan, as a provider of products and services enabling online offerings in Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to consumers at the link HERE.

The stated regulation stems from the Law on Extrajudicial Consumer Dispute Resolution, Regulation (EU) No. 524/2013 of the European Parliament and Council on online consumer dispute resolution and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/ES.
